These Terms of Service ("Terms") govern your access to and use of Brick's website and services ("Service"). By using Brick, you agree to these Terms.

If you don't agree, don't use the Service.

1. The Service

Brick provides software tools that help property owners understand and track building compliance obligations using public data and user-provided information.

Brick is not a law firm, regulatory agency, or professional advisor.

We surface information. You remain responsible for decisions.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding agreement to use Brick.

3. User Responsibilities

You agree to:

  • Provide accurate and up-to-date information
  • Use Brick only for lawful purposes
  • Not interfere with or misuse the Service
  • Not attempt to reverse engineer or scrape Brick
  • Keep your account credentials secure

Bad inputs create bad outcomes. That's on the user.

4. Compliance Disclaimer

Brick relies on public records, third-party sources, and user inputs.

We do not guarantee:

  • Completeness of government data
  • Accuracy of third-party information
  • That all applicable compliance obligations are identified

You are solely responsible for meeting all legal and regulatory requirements.

4.1 NYC-Specific Compliance Disclaimer

Brick provides information related to New York City building compliance requirements based on publicly available records, third-party data sources, and user-provided information.

New York City building, housing, fire, environmental, and energy regulations are complex, frequently updated, inconsistently enforced, and may apply differently based on building attributes, occupancy, usage, exemptions, agency interpretations, or factual circumstances not captured in available data.

Brick may reference or surface requirements associated with, including but not limited to, agencies such as the New York City Department of Buildings (DOB), Housing Preservation and Development (HPD), Fire Department of the City of New York (FDNY), Department of Environmental Protection (DEP), and other municipal, state, or federal authorities.

Brick does not guarantee that:

  • All applicable compliance obligations are identified
  • Any surfaced requirement applies to your specific property
  • Government or third-party data is complete, current, or accurate
  • Deadlines, penalties, or filing instructions are correct or up to date

Brick does not provide legal, engineering, architectural, environmental, or regulatory advice and does not replace consultation with licensed professionals or direct communication with the relevant authority.

You acknowledge and agree that:

  • You are solely responsible for verifying all compliance obligations
  • You are solely responsible for filings, inspections, certifications, and submissions
  • Reliance on Brick does not relieve you of legal or regulatory responsibility
  • Brick's outputs are informational only and provided "as is"

New York City agencies may issue violations, penalties, or enforcement actions regardless of information presented by Brick.

By using the Service, you expressly assume all risks associated with compliance decisions, filings, and enforcement outcomes related to your properties.

5. Payments and Subscriptions

If Brick offers paid plans:

  • Fees are billed in advance
  • Payments are non-refundable unless required by law
  • Pricing and plans may change with notice
  • Failure to pay may result in suspension or termination.

6. Intellectual Property

Brick owns all rights to:

  • Software
  • Content
  • Branding
  • Logos
  • Designs

You receive a limited, non-exclusive, revocable license to use the Service.

Ownership does not transfer. Full stop.

7. Termination

We may suspend or terminate access if you:

  • Violate these Terms
  • Misuse the Service
  • Create legal, security, or operational risk

You may stop using Brick at any time.

8. Limitation of Liability

To the maximum extent permitted by law:

  • Brick is not liable for indirect, incidental, or consequential damages
  • Total liability will not exceed the amount paid by you to Brick in the previous 12 months

Brick reduces risk. It does not assume it.

9. Indemnification

You agree to indemnify and hold Brick harmless from claims arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your failure to comply with laws or regulations

10. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

11. Changes to These Terms

We may update these Terms. Continued use after updates constitutes acceptance.
